TERMS AND CONDITIONS APPLICABLE TO THE FREDDY HIRSCH

CONSUMER TRIP TO FRANCE PROMOTIONAL COMPETITION

In order to promote its products, Freddy Hirsch (Pty) Ltd ("FHG"), is conducting this promotional competition ("the Competition").

By entering the Competition, you agree to be bound by these terms and conditions.


Special note must be taken of all clauses that have been inserted in bold. Please ensure that you understand the consequences of these clauses.

  1. Who may enter
    1. You must be at least 18 years of age or have your guardians' consent to enter the Competition.
    2. The Competition is open to any such person that purchases one of Oom Freddy's Legacy range of products from FHG's authorised stockists.
  2. Who may not enter
    1. Directors, members, partners, employees, agents, contractors and consultants of FHG and any other person who directly or indirectly controls or is controlled by FHG, as well as any person who supplies goods or services in connection with the Competition may not enter the Competition and shall not be eligible to be awarded any prizes in the Competition.
  3. Competition period
    1. The Competition starts on 01 February 2023 and closes at midnight on 30 June 2023, however to the fullest extent permitted by the law, the duration of the Competition may be extended or curtailed at the discretion of FHG.
  4. How to enter
    1. Purchase one of Oom Freddy's Legacy ranges ("the Product"), from FHG's authorised stockists.
    2. Scan the QR code which you will find on the peel and reveal sticker affixed to the Product, and you will be directed to FHG's website.
    3. On the website insert the unique code which you will find on the peel and reveal sticker. Each valid unique code will give you one entry into the Competition.
    4. You will be presented with a form on the website which you must complete with the following details:
      • Your Name and Surname
      • Your mobile telephone number
      • The province in which you reside
      • The name of the store you purchased the Product from.
  5. Charges to enter
  6. Your standard data charges will be levied whilst you complete your details on the website. There are no further charges for participating in the Competition.

  7. Draws and Prizes
    1. Each valid entry will be automatically entered into a draw to be held on or about 15 July 2023 and five winners will be randomly drawn from the different provinces in South Africa, as follows:
      • 1 winner from the Western Cape
      • 1 winner from Kwazulu-Natal
      • 1 winner from the Eastern Cape
      • 1 winner from the Free State & Northern Cape
      • 1 winner from Gauteng, Limpopo, Mpumalanga and the North West.
    2. FHG's decision in respect of the winners of the Prizes is final and no correspondence will be entered into.
    3. The prize winners will win a trip for two to France from 20 September 2023 to 24 September 2023 ("the Prize").
    4. The Prize includes return economy flights for two to Paris departing on 20 September 2023 and returning on 24 September 2023, airport taxes, transfers to and from the airport in Paris, hotel accommodation in Paris on a sharing basis for 3 nights, breakfast daily, two category 4 tickets to the rugby game between the Springboks and Ireland, Official SA Rugby Travel memorabilia and group travel insurance. The Prize excludes any services not mentioned.
    5. The economy flights depart from and return to Johannesburg International Airport. Prize winners will be required to travel to Johannesburg International Airport at their own cost.
    6. The Prize is non-transferable, non-refundable and cannot be redeemed for cash.
    7. The Competition and the random draws will be overseen by FHG's independent auditors BDO.
  8. Notification of winners
    1. Once the draw has taken place FHG will use its reasonable efforts to contact the winners telephonically, by calling the number that was used to enter the Competition.
    2. If FHG is unable to contact the winner after reasonable efforts to do so as set out above, then that person's right to win the Prize will be deemed to have been waived, and FHG may then randomly draw another winner from the pool of remaining valid entries.
    3. As soon as reasonably possible after the Competition closes, the names of the 5 winners will be published on FHG's website - www.freddyhirsch.co.za.
    4. With his/her permission, the image of the winner may also be published on www.freddyhirsch.co.za as well as in FHG's marketing materials.
  9. General
    1. The Prize will be awarded to the person that entered the Competition and the winner will be required to identify him or herself by presenting a valid form of identification, (or by such other reasonable means as determined by FHG), before the Prize can be redeemed. Winners will also have to comply with any other reasonable validation procedures and any third party terms and conditions specifically relevant to the Prize, as may be reasonably required by FHG, in order to claim the Prize.
    2. Prize winners must be in possession of a valid passport that expires more than 6 months after 30 September 2023. Prize winners will be required to arrange the necessary VISA to travel to France at their own cost. Prize winners who are not in possessions of a valid passport or who are refused a VISA to travel to France will forfeit the Prize.
    3. If any winner is under the age of 18 years of age at the time the Prize is awarded to him/her, then the Prize will be awarded to his/her legal guardian, who will be required to retain the Prize for the benefit of the winner and will be required to complete all and any necessary documents or agreements in connection with.
    4. FHG reserves their right to substitute the Prize with another prize of similar commercial value.
    5. At the end of the Competition all of FHG's obligations in regard to the Competition as well as in regard to the Prize shall terminate.
    6. In the event of a dispute in regard to any aspect of the Competition and/or these terms and conditions, FHG's decision will be final and binding and no correspondence may be entered into.
    7. FHG is entitled in its entire discretion to reject any entry or participant if it believes there has been any irregular, fraudulent or mala fide conduct by, or on behalf of, such participant, and will not be obliged to notify participants of entries that are rejected.
    8. FHG may refuse to award the Prize if entry procedures or these terms and conditions have not been adhered to or if it detects any irregularities, male fide or fraudulent practices by, or on behalf of, any person claiming the Prize.
    9. The Competition is also subject to, and must be read in conjunction with, the terms and conditions applicable to the Prize, which will be provided to the winners.
    10. If the Competition is held to be or becomes unlawful or if FHG is required by the Minister of Trade and Industry or the National Consumer Commission to alter any aspect of the Competition, then to the full extent permitted by law FHG reserves the right to suspend or terminate the Competition immediately and without notice, in which event all participants agree to waive any rights that they may have in terms of the Competition and accept that no recourse will lie against FHG.
  10. Non Liability
    1. To the full extent permitted by law:
    1. FHG is not liable for any technical failures affecting participation in the Competition.
    2. FHG, its associated companies, agents, contractors and any of its personnel involved in this Competition, assume no liability whatsoever for any direct or indirect loss or damage, claims, costs, death or injury arising from participation in the Competition or from using the prize or howsoever arising. This clause means that you will be entering the Competition at your own risk and FHG will not be responsible to you for any harm you suffer as a result of your entering the Competition. If you or any third party sustains any loss, injury or death in connection with entry into the Competition, the selection of winners, any of the Prizes or making use of any of the Prizes, you or any third party will not be able to sue FHG or any of their directors, employees or any agents. If any third party suffers harm because of your participation in the Competition, you will be responsible to the third party and not FHG.
    3. FHG assumes no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever.
    4. FHG may in its sole discretion amend these terms and conditions at any time, without notice, and such amendment shall be deemed to have taken effect from the date of publication of the revised terms and condition on the website www.freddyhirsch.co.za.
    5. FHG reserves the right to cancel, suspend or terminate this Competition, without notice at any time and no liability shall lie against FHG, in favour of any participant or third party arising from such cancellation, suspension or termination.
  11. Privacy
    1. You hereby consent to FHG using your personal information in order to market its products to you once the promotion has ended subject to your right to opt out of such marketing messages and further subject to your right to restrict receipt of unwanted marketing material as contained in the Consumer Protection Act of 2008.
    2. Any personal information, including, without limitation, your name, age, contact details and other information obtained as a result of your entry into the Competition will otherwise be dealt with in accordance with FHG's privacy policy.
